Blue Cross Blue Shield Lost a $2.67 Billion Lawsuit. Check If You’re Owed Money.

Six million people filed claims against Blue Cross Blue Shield. Payments start next month. If you were one of them, you don’t need to do anything else — a check, electronic payment, or Venmo transfer is on its way.
The $2.67 billion Blue Cross Blue Shield antitrust settlement — the largest in the history of the American health insurance industry — has cleared its final legal hurdles and entered the payment phase. The settlement administrator confirmed this week that the initial distribution of payments to eligible claimants will begin in May 2026, nearly 13 years after the class action lawsuit was first filed.
After attorney fees and administrative costs are deducted from the total fund, approximately $1.9 billion remains for distribution. Divided among roughly 6 million approved claimants, the average payment works out to approximately $333. Individual amounts will vary based on how long you were covered, what type of plan you had, and how much you paid in premiums during the covered period — meaning people who had longer or more expensive plans will receive more.
The underlying lawsuit alleged that Blue Cross Blue Shield companies — which operate as independent licensees across all 50 states — conspired to limit competition between their member plans, effectively dividing the country into exclusive territories and preventing their affiliates from competing with each other across state lines. The result, plaintiffs argued, was artificially inflated premiums for millions of Americans who had no real ability to shop across BCBS plans for a better deal. BCBS denied wrongdoing and settled to avoid further litigation costs.
Who qualifies:
Anyone enrolled in a Blue Cross Blue Shield health insurance plan — individual, family, or employer-sponsored — at any point between February 7, 2008, and October 16, 2020, was eligible to file a claim. Self-funded account holders have a slightly different window, starting September 1, 2015. The claim filing deadline was November 5, 2021. If you filed before that date, you are in the class.
What you need to do:
Nothing. If you filed a valid claim before the November 2021 deadline, your payment will be distributed automatically through whichever method you selected during the claim process — check, electronic debit card, PayPal, or Venmo.
Claim determination notices have been going out by mail and email since February 2026. If you filed a claim and haven’t received a notice yet, that process is ongoing and payments will roll out in phases throughout May. If you received a determination notice that your claim was accepted, your payment is coming. If your claim was denied or you want to check your status, you can visit the official settlement website at bcbssettlement.com or call the settlement administrator.
What if you didn’t file a claim:
The November 2021 deadline has passed and is not being extended. If you were enrolled during the covered period but did not file a claim by that date, you are not eligible for this settlement distribution. You may still benefit from the injunctive relief portion of the settlement, which requires BCBS companies to change certain competitive practices going forward — but you will not receive a direct payment.
One important note: this settlement has been the target of scams. The FTC and settlement administrator will never contact you by phone or email to ask for bank account numbers, Social Security numbers, or any payment to receive your settlement check. If you receive such a contact, it is a fraud.
